- The process is fairly simple, the main principle being that every
side in the dispute must want to attend a mediation.
- If you are hesitant to invite the other side to a mediation, we may
do so after due consideration of the circumstances.
- We then set up a meeting at a time and place convenient to the parties,
to discuss the way forward.
- How we proceed from there, depends on the complexity of the matter.
- Should an independent expert's advice be needed, we suggest an expert
who is agreeable to every side.
- The expert does a report and this is given to the parties.
- They are entitled to bring their own experts to the table and must
give a brief summary of what their expert is going to say before the
mediation.
- Once everything is in place and the formalities have been adhered
to, we have a mediation at a convenient time and place.
Lawyers
- You do not need your own lawyer to take part in a mediation.
- However, should you already have a lawyer, you need to inform your
lawyer in writing of your wish to take part in mediation and your lawyer
should confirm in writing that s/ he is agreeable to mediation.
- Should litigation of the dispute already be under way, you need the
written permission of your lawyer and the lawyer on the other side,
as well as of the client, to fill in an application for a mediation
form.
